A title deed is a legal document evidencing ownership of property. It is the most important document you receive when you purchase land or property in Kenya.
There are two types of title tenures: Freehold and Leasehold. Each comes with different rights and conditions on how you hold the property.
A freehold title deed gives the owner absolute ownership of the property with no time limit. A leasehold title deed is held on a national government or county council lease for a specified period of time.
The period varies by property. Some properties have a term of 99 years and others 999 years. The term is clearly stated on the title deed document.
Legal fees are based on the Advocates Remuneration Order and are dependent on the value of the property. They cover services offered by an advocate for the sale and/or purchase of a property.
Tenure refers to the rights and conditions on which a person holds a property — including any obligations, restrictions, or benefits attached to the land or title.
Stamp duty is a government tax levied on every property transfer. The rate is determined by:
- Value of the project, mainly dependent on developments within it
- Proximity to key public utilities
- Locality — Nairobi & environs: leasehold 4% Other areas: freehold 2%
